Bad experience with eBay seller Bandersnark, also known as Snark on this forum.

Hi all,

here's a "nice" story about my recent experience with this person from Canada.

I bought the following The Cure cd from him:

I bought it, thought he could be trusted since he also listed here. To be sure, I asked Roger Epperson's opinion a few days later (stupid, I know) and he said: "afwul item and not even close".

I asked Snark to refund me, off course after I sent the item back to him. I did the item (even unopened) back to the post and sent it back the 9th october (I have a recipe of the shipping costs I made, but of course this has no value).
I mailed Snark and he only said: "I hope you used tracking, because otherwise there is no guarantee I will ever receive the item back". I already saw the problems coming: he immediately covered himself by asking if I used tracking. I knew that I would never get a refund.
I also asked him to refund my shipping costs because that seems logic to me. His answer: "nice try, why would I do that?".
Maybe less common but I also asked him to refund the 15 dollar I paid for Roger's opinion. To me this seems logic too, I refer to his description on eBay: "I guarantee that these autographs will pass authentication by Roger Epperson".
Seems this phrase has no value at the end.
He also states that "further details of signing will be given to the buyer". I haven't receveid any details because I'm 99,9% sure he wasn't there when the cd was signed.

I didn't answer him and let it go for a few weeks, because off course I didn't use tracking. I just posted the item the normal cheapiest way, and never ever had any problems with this way of posting in all the transactions I did (all sort of items from all over the world). 20 days later he didn't receive the item so that's impossible. I'm 99,9% it's already collecting dust in his house.
His last mail states: "let us be honest, if you are trying to get a refund, you should have used tracking".
Maybe the item is still on its way, but I don't believe in fairytales.

But in the end, he'll say shortly with a smile that it's his word against mine. It's easy to cheat on people far away from overseas. I know I'm right, I'm just a music lover searching for genuine items, nothing more, nothing less.  I rely on the honesty of traders when I do transactions. 
Another lesson in the autograph hunting for me, and maybe other buyers will think twice if they want to buy something from him.

that's a bingo.

They don't always need to receive it back.   However, he only has 45 days from the date of payment in paypal to open a dispute, so if that clock has run out, he's out.  If not, he can still file a claim.

Here is an attachment of the recipe from my shipping costs at the post-office. The above is a bit vanished but it's clearly sent the 9th of october, prior international (INTL) shipping for 8,34 euros. Not that much value I guess, but it's something... Maybe he can say it could be for another item?

I'm a huge The Cure fan, already searching for a longtime for a nice genuine item. When I got the opinion from Roger the item was a forgery I was very dissapointed and I sent it back immediately. Than I saw the The Cure cd on Roger's site and bought his immediately. I also thought, well I'm getting my money back from Snark, so I'm happy to have some money available again! :-).  Our friend Snark makes a weird story about this, but I still don't see what's wrong about it.
You know what I would really have liked? That Roger said the pornography cd was genuine, because it's one of my favorite cd's, far more than the Bloodflowers cd from Roger.

So why on earth would I NOT return the item? Why on earth would I put energy in a thread like this? To hang an awful item on my wall? I'd rather have my money back off course.

You don't have to be a psychological wizard to see what's happening. I already said it: his short answer when I said I shipped it: "you did use tracking did you?". "Nice try" where the other answers. His arrogant, one-liner communications really make me angry. If I was a seller it wouldn't come up with me to ask the buyer if he did use tracking. "To make the transaction smoothly", lol.
And off course, I didn't answer him immediately when he asked if I use tracking. I'm no idiot. My chances of refund were 1%, I didn't want to bring them to 0%.

Just read his ridicoulos comment on ebay: "no reject letter for autographs. haven't returned anything. Fraud".
I have the mails from Roger in my mailbox. What a weird definition of fraud he has.
Of course he lies there, he hopes ebay buyers won't see this thread, and it's his word against mine. But at least he still has 98,7% satisfied customers!

Yeah, he made it known from the start if you didn't use tracking he probably wont get it.

Sucks for you but hopefully others have learned from dealing with this goof.

You are committing fraud by not returning the item and expecting a refund.

If only you added tracking, as I requested it twice. Seeing the item tracked in transit would constitute a refund, prior to it being received.

Wow Snark over a punk ass $100.  You could have saved name and face by just refunding. 

I won't entertain extortion.

One thing i will say, is that sometimes the shipping to these places can be crazy slow. I know that i have shipped a couple items to a really nice guy down in Brazil, and it has taken over a month before to get his packages. And thats with tracking all the way. So maybe thats what happened and the item is just momentarily tied up in transit. If its been more than 45 days, then thats another story, but i have had items take around a month before to get to the hands of the owner. We really are spoiled with shipping here in the USA

Could be Carl, but the chances are very very small it's still on its way. I received his package very fast, after 6 days. It's been 3 weeks now.
When I get something from the USA, it's also never more than 1,5 week.

If this will make you feel any better, I had a package that took over 60 days from Sweden to the US. It was something that I bought on Ebay and it didn't get stuck in custom. And this was not with tracking.

I had one package from the UK stucked in custom for almost 3 month! They only found it because I had tracking on it.

So there is still a chance that the package will come here.
