Ebay Removed My Derek Jeter 1995 Action Packed Diamond Autograph Card Listing Policy

Well, for the third time in approximately six months, Ebay has removed one of my listings.

This happened today, January 25, 2014.

First, below is the message I received from Ebay.

After reviewing your eBay account, it appears that you have violated eBay's Trademark Violation - Unauthorized Item policy. As a result, we've taken the following actions on your account:
- Selling privileges have been temporarily restricted. You won't be able to list new items for 30 days.
- Violating listings have been removed. A list of items that were removed can be viewed at the bottom of this message.
- We have credited all associated fees except for the final value fee for your listing(s).

The listing that was removed appeared to violate eBay policy or a rights owner's trademark. Please remember that you are responsible for the quality and authenticity of the products that you offer on eBay. It is against eBay policy to list any counterfeit items.

For more information please see our Replica, counterfeit items, and unauthorized copies policy:
http://pages.ebay.com/help/policies/replica-counterfeit.html

While we understand that it was never your intention not to be in compliance and that you may not have been aware of this, please take note of the following factors which were considered when your listing was removed:

For autographed items like this, please be sure to provide a Certificate of Authenticity (COA) coming from the approved authentication companies of eBay (specifically - Global Authentics LLC, James Spence Authentication & PSA/DNA), and in the listing include a picture of the COA and the name of the issuing authentication company to give buyers confidence/trust in purchasing your items. To check on the approved authentication companies of eBay for your reference: http://pages.ebay.com/help/buy/authentication.html

Consider those factors to further improve your future listings, become a more successful eBayer & improve your future sales.

We'd like to warn you and give you a chance to improve your listing, but because we have to act quickly, that's just not possible. Moving forward, please consider this as an educational experience that you may use for more successful transactions on eBay as you are now aware of these guidelines.

Please understand that although there may be other listings currently on the site that are in violation of our guidelines, please be informed that this policy applies to all the members, so if you come across listings similar to this which you feel are in violation, kindly report them using the report item link on the listing page. We sincerely appreciate your understanding and cooperation.

During this restriction you can still:
- Send email
- Obtain shipping addresses
- Leave Feedback
- Perform other administrative tasks

After 30 days, your account will no longer be restricted. However, please be sure your current and future listings follow these guidelines, keeping in mind that additional violations of this policy could result in the suspension of your account.

If you have additional questions, contact our policy experts.

We understand that you may have been unaware of this eBay policy, and we encourage you to learn how to keep your experiences on eBay successful.

Here are the listings that were removed:
331113459822 - DEREK JETER AUTOGRAPHED 1995 ACTION PACKED DIAMOND.

We appreciate your cooperation.

Thanks,

eBay

Please don't reply to this message. It was sent from an address that doesn't accept incoming email.

Here is the item in question.  It is a Derek Jeter "1995 Action Packed Diamond" autograph card.  These were issued by "Action Pack" back in 1995.  500 were autographed on card number "1A" by Derek Jeter and 500 were autographed on card number "1D (Diamond Version)" by Derek Jeter.

Here is the photograph of the aforementioned card.

Now, of course, there is absolutely no doubt that this is Derek Jeter's circa 1995 autograph.  There are at least four or five of these on Ebay every day.  Over the years, I have owned approximately 20 of these Derek Jeter autographs (the 1A and 1D versions combined).

This time my "Listing Ban" is 30 days.

You see, Ebay is targeting me because, and in my opinion, they don't like me exposing the forgeries because it cuts into their profits and bonuses (John Donahue, CEO, Ebay).

This is Ebay's way of "Sending me a message."

The irony of the above Ebay message is the part that reads "so if you come across listings similar to this which you feel are in violation, kindly report them using the report item link on the listing page."

So, after Ebay removed my legitimate auction, they want me to go out of my way to report Ebay violators."   What a bunch of morons!!!

And while Ebay continues to harass honest Ebay members like myself, they continue to profit from forgeries like the one below "authenticated (cough, cough)" by Steve Sipe (Global Authentics) that recently sold on Ebay.

As a matter of fact, Ebay has profited from the sales of hundreds upon hundreds of Derek Jeter forgeries certed by Steve Sipe of Global Authentics one of Ebay's Trusted Third-Party Authenticators.

I know Ebay thinks that maybe now I will go away.

No chance, Ebay and John Donahoe, CEO.

I consider their targeting me as a "Badge Of Honor" and flattering.

I agree, Fudd.

It's no big deal that I'm unable to sell for 30 days.

Unfortunately, Ebay has allowed the sellers of forgeries to run amok over there.

By the way, as a NY Rangers fan since the early 1960's, it's been fun watching the Rangers & Devils playing outside at Yankee Stadium.

amen to everything you stated, Fudd!

I could make a career of reporting fake U2 items on Ebay.  The majority of them are so badly done that even a novice could tell they're forged.  Some flat out look like a toddler did them.  Arguably the biggest active band in the word, and Ebay doesn't feel like taking any action.  But when one of their minions buzzes in their ear for the sake of hurting a collector who knows what he's doing, they don't refrain from poking that seller in the eye.

The current person in charge of collectibles over at Ebay is a complete waste of space.

My personal opinion is eBay is not as smart as you are all saying. Every time I have spoken to them it seems like a random Indian person I'm talking to that has little idea what I'm talking about, they are only reading pre written quotes etc.
If forgers can play in ebays system how can't you smart guys.
Hey if I had a mantle item and it had a Coa from Chris I would be very happy. So what is the problem with Chris doing his own coas? You're gaurenteeing the item you are selling. You know its real so there is no problem.
I think that is all eBay wants.

Do you think the random Indian person who saw your Jeter card reported knew it came from a pack? Highly doubtfull. I wouldn't of even known so. I don't think you are dealing with professionals at eBay. If so we all wouldn't be reporting hundreds of items everyday.

I have had items removed from eBay before. The first time because I mentioned UACC.
The 2nd time because I used a proof photo of Andrew Bogut that be had signed for me in person. Aparently I was breaking his "vero" rights by using that photo he hasn't given permission for. WHAT?

But since then I have played ebays game and have had no dramas. I will offer a as you say "piece if s*** Coa I made up myself" for all my items that aren't PSA or JSA. My buyers are happy with this and so is eBay.
I will gaurentee everything to pass PSA or money back.

All the things you guys regularly bag out I do. I do it because that's what eBay wants. You often say forgers do that same thing. They have figured out the system. You guys also only have to add those few words to your description. Comes with Coa and gaurentee to pass PSA.
Done. How easy is that?

At least try it and if they ban you while doing what they want then you really know this is personal.

Chris,

I am furious that those cowards shot you in the back again. eBay has to be held accountable. They can't keep using the stupidity defense.

It's best that we not guess who fraudulently reported Chris to eBay. Let's face it, if we rounded up the usual suspects there would be hundreds. So unless there's strong evidence that a particular person or entity is involved, I would appreciate it if they aren't accused of doing it.

Thanks...and keep up the good job, everyone.

You're really making a difference.

Thank you, Steve.

Love that "Stupidity Defense."

Three times is not a coincidence.

I agree Steve, I have no inside knowledge of anything..I'm only trying to connect the dots?

Comment by Steve Cyrkin, Admin on January 26, 2014 at 5:48pm

And like most poxes, there are lots of dots to connect, Fudd, aren't there?

Steve Sipe from Global Authentication posted this on my profile to assure us that he didn't report Chris to eBay:

Steve,

Impressive display of nut bags you have over there. Below is an email received today from Chuck and quite honestly I cannot believe that this is even being implied. I have never once done such a thing to anyone and do not intend to do such a thing in the future. This conspiracy theory must end as it is completely wrong in everyway.

The card in the link that Chuck sent me is clearly legit/genuine and it is evident that someone is messing with Chris but I can assure you that it is not me. I seriously could care less about what he sells/buys has pulled down and since all of your followers will not listen to what I tell you about the fact that Bob Gryder did all of the Jeters/Rivera's in question and behind the scenes was actually an owner of Pristine Auctions. This is why he was fired almost two years ago.

Unlike you folks I am not cut from the same cloth and do not seek out harmful ways to mess with people ask Chuck is suggesting in the email below. The fact remains that your posse has way too much time on their hands and the crazy stuff that is being said is without merit, especially this particular instance. I cannot reply to Chuck so please let this moron know that he is way off base on this very charming email.

I think you are a chickern s*** f***** for pulling those Jeter cards while the Jeter fakes you are certifying are the new normal. How the f*** do you sleep at night f***face, Chuck
