right; - this is all linked to a case with in item where paypal had blocked funds & seller in the end , sent the item. I was honest and told him it had arrived , altho I didn't have to sign for it and due to unforeseen circumstances couldn't look at it for 3 days. Imagine my horror when some imprints from a note he had written to me appeared on 3 of the pages; - one of them on the sigs & I posted the problem up yesterday on AML
I wrote a super polite letter to him this afternoon; - he has now accused me of lying; has sent a copy of my email to his lawyers and to paypal this afternoon. He says that if I send it back ; he will examine it to see what I have done to it and will take legal action against me; - or I end this nonsense
I did want the item and thought a partial refund would be in order but am now going around in circles with worry after receiving this item. I have asked to be put through to trust and safety at ebay but you just go around and around in circles
I am horrified by such a letter. I am actually quite a nervous individual; - can't think what to do now. Please advise. HELP

Report it to eBay as "Item not as described" - it isn't. Indicate to eBay that the seller's note and imprints damaged the item. In 99% of all cases, eBay will side with the buyer and force him to take it back or restrict his selling privileges.
Take photos of the note, and if possible of the imprint/damage. You have nothing to fear if you can back up the claim. For what it's worth, I'd be shocked if he truly had a lawyer working on this. You may also want document this threat to eBay, as well.
thanks - I did ring ebay . They said it was inappropriate email but not threatening because he hadn't threatened to kill me (good news that). The problem is the imprints are difficult to take photos of; - I was just expecting him to say sorry rather than launch into such a frightening tirade and maybe take something off the price. I feel a bit better that you think that you feel its unlikely he's got a lawyer there; - it was all so unexpected really. ebay is closed now and paypal doesn't open till Monday anyway. It never rains but pours!!!
I agree with hitmanten. This seller is talking a lot of twaddle. If there is any sort of problem with an item ebay will side with the buyer. I would just "open a case" and forward any insulting emails to ebay. They'll chuck him out in no time. I've had a few of this type of seller before - lawyers, my a***. No lawyer in their right mind would get involved with such a nut.

I didn't see your listing yesterday, but don't worry about lawyers. They cost thousands and are generally only threatened by sellers having something to hide. I'd just return the item as not as described and leave it at that.
Stop talking to them. And let ebay decide.
Firstly you are UK based and from memory he is based elsewhere so how can he sue you and serve you when you are not there? Secondly based on the cost a lawyer would cost more than the item is worth so this is total rubbish and designed to throw you off the scent and make you do as he wants.
As hitmanten says it's open a case, report not as described and give him a couple of days then escalate the case and send back via courier.
yeah open a not as described case you dont need to speak to them do it on the e bay page he hasnt a leg to stand on he should have done the polite thing and partial refunded as it was his fault he damaged it ,if you still want it you can put that in the case that its damaged and select partial refund as an option ,its worth a go he wont want it back damaged and it saves all the posting back and forth ...dont forget if you do return it get tracking
If the imprint is able to be read I would take pictures of that and keep the original note he wrote. I agree I would not worry about the lawyer unless it was in the $1000s of dollars it would not be worth his while. Do not lose any sleep over a lawyer.
I just want to back everybody up. Anybody can threaten with lawyers but this guy is not going to a lawyer. They cost a couple of hundred an hour depending, and this guy isn't going to do that. Stay calm, let Ebay handle it.
