Thats quite worrying to learn that a reputable auction site like this would offer fake items.

The seller was a company called NGU Memorabilia

I've got 2 questions.

1. How does anyone know the autograph is fake before buying it (this one seems legit)

2. How does a company like this legally offer fake items without getting caught?

I do not think "reputable" is the right word. Use the search engine.

The answer to your first question is "by looking and using your eye, developed with lots and lots of experience, knowledge, research and observation into that one graph".

+1. This one is consistent with a known forgery style in addition to the poor reputation of the sellers.

It looks pretty good.

Its very hard to tell if its fake.
