All you can do is report it to eBay. I recently encountered this item and nothing was done about it. Although the seller cannot fulfill an order they don't have in their possession. It's not on you, it eventually will bite the seller in the rear end.

This is the company that holds Jerry Garcia's copyright and rights to use of his name. There's a good chance they use eBay's VeRO program (Verified Rights Owner). Tell them what's going on and ask them if they would be kind enough to file a notice with eBay. Not just for you, but because someone who knowingly offered this is likely to do it again with other Garcia memorabilia.

I actually own both the film and soundtrack copywrights to this (was a work for hire he did in 63' for woman getting masters at Stanford). I was actually alerted of this by people from the Grateful Dead camp-Brian Miksis /dennis mcnally who produced and upcoming rounder records jerry garcia box set. I have Garnder/Rosenberg on it.
Good. If they don't have the info I just gave you, that's who they need to contact, since it's not a Grateful Dead rights issue.
If it's a copy of the film that was made legally under the terms of the agreement, then Ballroom is likely right.
If it's an original 35mm film and they're offering it without copyrights, I don't see how you could do anything about it. They even included the following in the auction description:
This film is sold from one collector to another. No rights are implied.
You may be right-I own copyright of it and the only known 35 or 16 mm (can't remember which) cannister of it outside of Stanford Thesis files...but I bought it thru the crooks Itsonlyrocknroll who may of made a copy-otherwise can't figure out where the ebay sellers 35 mm came from
If it is a legit copy and being sold as an object then I may not be able to do anything-but if it was illegally copied ....
Ah, it's actually 16mm. The seller mentions that in the auction description.

if u sell with copyrights prices can get to very expensive if no copywtight its just one collector to another
wolfgangs vault tried suing everyone on ebay for listed a bill graham poster asking us to pay a photo imaging fee even though we weren't reprint things just selling an itiem I owned.
it got reall nasty and a lot of court cases that why u see people actualy post disclaimers on art because wolfgangs vault sued every one
Just curious. Have you tried contacting the seller about this to possibly get some background information on how they obtained it? Inquiring minds would want to know.
I agree with Joe. I thought you meant it was fake. If they have a real vintage copy of yours they may not be bad guys at all and would want to know if there were rights concerns.
I just sent an email to them and will see what happens
